Changes to the E-Filing system — Technical solutions to address the issue of multiple filing of the same estate

The Office of the Superintendent of Bankruptcy (OSB), in collaboration with Industry Canada's central departmental experts, has taken measures to implement the following technical solutions to the OSB's E-Filing system to address the issue of multiple filing of the same estate:

  • Upon successful submission of new initial filings, all certificates displayed automatically on the E-Filing screen will now also be sent by a system-generated email to the trustee.
  • Please note: The option to print the certificate directly from the E-Filing web page will remain. Trustees are reminded to log onto the OSB's E-Filing system and to click on the "Preferences" button in order to indicate their choice of email address(es) regarding where the certificates will be sent.

  • Initial Filing "Pending Review" — When new initial filings are received for revision by the Official Receiver, the  E-Filing system's web page displays the message "Pending Review" as well as the temporary estate number. The new solution implemented in the OSB's E-Filing system will also send the trustees a message in the form of a system-generated email indicating the temporary estate number and that their submission is "Pending Review." Trustees are reminded to log onto the OSB's E-Filing system and to click on the "Preferences" button in order to indicate their choice of email address(es) regarding where this message will be sent.
Pending Review Notification
  • Initial Filing Rejection Message — The OSB's E-Filing system will now automatically reject the trustee's new initial filing of an estate if it detects that an identical estate has already been filed by that same trustee.
  • Important reminder: This does not preclude the trustee from searching OSB records when determining if there are prior and/or undischarged proceedings. The hyperlink for OSB Bankruptcy and Insolvency Records (Name Search) will continue to be made available to the trustee on the OSB E-Filing system's "New Filing" web page.
